  • Parking Ticket = Gross Misconduct = Dismissal?

    My daughter is 25 years old and worked for a small company providing a support service to its clients. She's only been in the job for 6 months. During that time, the MD developed a hostile attitude toward her and, in meetings would refer to her as 'the dumb blonde' which my daughter found very distressing. Despite all the hostility and sniping, my daughter carried out her duties to the complete satisfaction of her line manager. During her 'one to ones' to with her line manager, the hostile environment was discussed. Her line manager would often ring my daughter following one of these difficult episodes to give her reassurance.

    Two weeks ago, my daughter parked the company provided car illegally and got a parking ticket. She immediately reported this to the reception staff and also offered to pay the fine. This has happened several times to other members of staff.

    The following day, my daughter received a phone call from her line manager informing her she was suspended while they investigated the parking ticket incident! There was nothing to investigate - she got a parking ticket FACT. A week later she was informed by her line manager that her employment was being terminated for 'gross misconduct' - the parking ticket! My daughter is devastated.

    My daughter spoke to a solicitor (family friend) who in turn wrote to the MD of the company. This resulted in two meetings.

    Yesterday my daughter attended a meeting with two other people appointed by the company to discuss her situation. She was not allowed to have any representation. The two people present were from the HR department of an unconnected company, one being a witness. These people presumably were paid buy the company.

    My daughter was invited to discuss all that had gone on and how she felt she'd been intimidated.

    Today, my daughter was invited to a second meeting. This time the meeting was chaired by a lifelong friend of the MD and a witness. Once again my daughter had to attend alone. The tone of the meeting was set right from the word go when the chair stated he had far better things to do with his time than be there! Each time my daughter started explaining her position, she was shouted down, the witness also gave her a bashing. At one point my daughter became so distraught she had to go outside to get some air, have a cry and then compose herself. The meeting continued in the same hostile atmosphere.

    Needless to say, I'm very supportive of my daughter and very proud that she found the strength to face these challenges.

    It seems that as my daughter has only been working for the company for 6 months or so, she has very few rights, if any.

    I'd be interested to hear any comments from anyone with knowledge of this field.

    If you feel inclined, you might hit them with a SAR (Subject Access request), under the Data Protection Act 1998 (they may charge a small fee for this). That might turn up some embarrassing correspondence that could be used as a lever.

    It is a pity that your daughter did not avail herself of a small, cheap, covert recording device.

      If your daughter was treated less favourably than male members of staff,eg if male staff members got parking tickets on company vehicles and were not sacked she can bring a claim for sex discrimination - for which there is no minimum qualifying period of service.

      Is she a member of a trade union at all ?

        Calling her a 'dumb blonde' is very much sex discrimination.
        What a horrible employer, I do hope she finds a nicer place to work.

          Thanks everyone for the replies - I really needed to vent my frustration! All parents want to protect their children and this is the first time my daughter, who's had a job in one form or another since the age of 14, has faced such a horrible employer.

          This was my daughter's first job since graduating from Uni, so she's definitely not a 'dumb blonde'. I agree, calling her that, knowing it distressed her is indeed sex discrimination.

          Regrettably she's not a member of any union but this incident has focussed her to join in the future.
