  • 'Referred to DPP'.

I am a voluntary youth worker and a young man informed me that much to his surprise someone associated with his work had report him to the police for making a rude gesture to him. A police officer questioned him and after he explained things he was asked to return to the police station a month later. There they arrested him and charged him but after further questions they asked him to come back one month later but seemed to suggest that would be the end of the matter. His solicitor advised him not to accept a PND as he thought the evidence was so flimsy that no court would convict him. On his latest return, the police informed him that the case was being referred to the DPP. Is this usual for a minor offence with flimsy evidence? Could it be that the person who lodged the complaint is demanding action? The young man explained that what was interpreted as a rude gesture was something quite normal that was mis-interpreted and says that the police seemed to accept his simple explanation.
