    It's rather academic to argue about whether or not diabetes is a disability under DDA as that act was repealed in its entirety by the Equality Act 2010.

    Under that act you are prote
    cted if you have a disability.
    You are considered to have a disability if the impairment is substantial and long term effects, even if the effects are held at bay by medical treatment.
    Whether or not diabetes controlled by diet alone would be considered a disability under the 2010 Act is a decision to be argued about.
    On a practical level, it seems to me the OP has to "eat on the go". If that means he might put his health at risk he will have to decide if that is a risk worth taking. If the shop is not busy enough to employ more staff to provide cover, his employer doesn't have much choice either.

    The Clark v Newquest Media doesn't really apply to this case as Melanie Clark controlled her diabetes by insulin injections four times daily.

      OP clearly states they have Type 1 Diabetes. Type 1 Diabetes cannot be controlled by diet alone as the body does not produce insulin.

        Repealed isn't the correct word. It was replaced and added to. Most of DDA still exists in its original form under EA2010. EA simply brought together other areas of discrimination under the same umbrella.
