    Hi all,


    My partner is currently employed by Serco and has been for around 14 months. She would like to leave the company as soon as possible but is slightly confused over the notice period required. Her contract states:


    Notwithstanding the anticipated date of termination indicated above, the Company reserves the absolute right to terminate this contract when it believes you have prevented the purpose of the contract being fulfilled. You may also terminate this contract at any time, by giving notice.

    13.2 In the event of the contract no longer being continued, notice must be given by you or by the Company which will be one week, until you have been continuously employed for two years. Thereafter the Company may terminate your employment by giving you four weeks’ or statutory notice, whichever is the greater. You may terminate your employment by giving four weeks’ written notice to the Company.

    Am I correct in thinking that the last line “You may terminate your employment by giving four weeks’ written notice to the Company.” Is referring to the period after you have been employed by more than two years?


    If so, am I correct to assume she is only required to give one weeks’ notice?

    Unless anyone has another opinion, thats certainly the way that I would read it. 1 weeks notice unless 2 years service has been completed.

      Agreed, 1 weeks notice up to 2 years employment, thereafter 4 weeks.
