    Hi, this is a post on behalf of my 18 year old son. To give a bit of background he has worked for the company for 3 years. He was employed as a chef in the pub that I am head chef in but was recently given a substansial promotion and moved to a new pub. Since being there he has been given no training on how to do the new job and all the other staff have had various problems meaning there has been a huge staff turnover in the first couple of months.
    This all unsettled my son and he has asked for a tansfer which was agreed that he would come back and work with me. It has now turned out tthat they have said he can only transfer back if he goes back onto his old salary. He has said that he is not happy about this d has just told me he w shown an email from his manager to the excec chef saying if he doesn't move and stays there he will be managed out of the business.
    What are my sons rights here?

    If he took a promotion that he knew meant going to a different location then he may not have any rights at all. If it didn't work out in the new job and requested a return to his previous workplace, the employer may very well be within their rights to claim that they assumed he wanted his old job back. He can't now just say that he wants his old job back but he expects to keep the higher salary that came with the new job.

    An employer saying in an email that he will manage him out could simply be construed as him saying that he'll dismiss your son if he insists on keeping his new salary on his old job. Saying that you'll manage him out sounds devious and it is. However, an employer can suggest that he just meant he would dismiss him if he insists that he keep the new salary but get his old job back. An employer could legally do that I'm afraid.

      No he is saying that if he doesn't move and stays where he is then he will manage him out

        Sorry but that seems pretty fair to me...If he does not want to be there then he obviously has to go,no buisness needs employees who are not happy with there role...and if he does not want that job and the pay that goes with it, then that is his choice and he must take the pay cut...thats how I see it.

          Your son needs to make it clear to the employer that he is willing to try again to make his new role work. If he isn't, then the employer has the right to get rid of him I'm afraid. It may seem harsh but employees often think they have more rights than they do.
