    Hi everyone, hoping someone can help... I've worked for my employer for 12 years and been in my current role for 7 years. I had a contract in my old role which states I do late and early shifts with every other saturday but when I moved to my current role the hours changed to just mornings but my contract didnt change.My employer now wants me to change back to my contracted hours but remain in my current role. I am unable to work my old hours as I have since had a baby and it would affect my childcare. My employer doesn't seem interested that I have child and just advised me that he can give me 12 weeks notice to change me back. I have applied for flexible working hours and still waiting for a response but my boss said he knows it will be turned down. Is there anything I can do? Is a verbal agreement for 7 years not count for anything? Any help on this would be great. Thanks inadvance

    Hi, yes a verbal agreement and the fact that you have had a set working pattern for so long indicates implied terms.

    If he wants you to go back to the old hours then it must be with agreement of both parties, if this is no longer suitable for you and you say you have requested flexible working hours they have a duty to consider it.

    After the 12 weeks is up, or if you both cannot come to an agreement he would have to start dismissal proceedings, keep everything in writing as you may have the opportunity to push for unfair dismissal.

      Hi thanks for getting back to me. I have spoken to my union and they have said its not a verbal contract but feels hopefull on the change off hours as my boss can not prove detriment to the business as I've been doing the hours for so long and its had no impact before. thanks again tools
