  • What can I do?

    Hi I am new to this so please be kind and bear with me if it seems a bit long winded!

    Up until the end of January I have been self employed. Due to a recent downturn in demand, I was forced to give up my business and seek employment. I found two part time cleaning jobs, which together with a top up of tax credits seemed like a workable solution. One job is 10 3/4 hours a week and the other is 10 hours a week. The second job is 5 hours in one place and then 5 hours in another place if that makes sense? The first job is ok and I have no problems there. The second job has been a nightmare! I started at the end of Jan and have not been paid yet! Excuses have been all about not having paperwork, bank details etc. They have had these on several occasions and twice I have got in the car driven a round 30 miles to give them to manager. Last week I was told that they could not pay me as my crb check which has been done by them was not complete and they could not issue a payroll number until it was completed! On Friday I was cleaning in one of the banks when I tripped on a loose piece of flooring at the top of the stairs. I managed to save myself so did not fall down them all just the first 4. I cant say that I have hurt my back, but those of you that suffer with back pain will understand when I say that I feel like it could give me a lot of pain if I am not very careful with it at the moment. Last time I hurt it I had 4 months of agony and paid loads of money with chiropractor to get it right. I think I am justified in being cautious with it. I want to ask what are my rights regarding not getting paid? I am absolutely skint without these wages. I want to tell that company to stick its job, but with only working 10 3/4 hours for the other company I wont be able to claim tax credits anymore. Also if my back does go I dont know how I stand having two jobs and sick pay? Also if they dont pay me this week and I say I cant work for them anymore how would I stand with regard to claiming JSA while I look for another job. I feel like I am going mad thinking about it. I really need to know my rights as if I dont receive wages from them by Wed at the latest I wont be able to continue to work and will not be able to afford to get there. Please can somebody advise me as to my rights I would be very grateful. Thank you

    What date did you start the job you are having difficulty being paid for and are you being paid weekly or monthly.

    Let us deal with this issue first, I understand and sympathise about your back but we need to get you paid first.

      Thank you for replying. I started on the 30th of Jan. I was told monthly pay on or around the 21st of month. They were happy to give me keys for two banking establishments on the day I was interviewed. My paperwork was seen and approved that day I assume, as I was given said keys. I have contacted tax office as I paid emergency tax on my other job and wanted to get the right tax code. I was told that the other company had not contacted them re my employment so it was likely that I would pay emergency tax on this wage also. I am at the end of my tether. I have 2 children and need my wages, desperately. thanks for your help.

        Have they issued you with a pay slip detailing the amount you should have been paid including TAX/NI deductions

          I have not received anything from them with regard to wage slips or any payments. I have had nothing in writing regarding employment apart from being given a handbook on day I was interviewed

            OK, you are entitled to receive notice of pay on or before you are paid.

            You are also entitled to be paid, on this occasion the 21st, on time.

            As you have not been paid on time it is classed as a deduction from your wages (100% in your case) and without notice they may be breaking the law. Contact them 1st thing tomorrow and tell them as much.

              Thank you I appreciate that. They are a big company with some big cleaning contracts so I did not expect issue with payment of wages. It has made me nervous about spending anymore time and money working for them if this is how they treat employees! I will have a look at the link thank you

                Make a note in their accident book about your argument with the stairs!

                CRB check should have no bearing on whether they pay you or not

                  Hi thanks for replying. Yes I hope to fill in accident report tomorrow. I have still not received any payment from them. Today I have contacted them via email to ask for wages and wage slip. I have also put this in writing. I am not in a position to work without getting paid, and as from today I cannot afford to travel to work if I am not getting paid. I have tried to find out if leaving due to not being paid will have adverse effect on my JSA claim. I have had to ring HMRC to cancel my claim for tax credits. This company has not contacted HMRC for to add me as an employee either! I feel absolutely let down and in limbo! I work to earn a living not for a hobby and this company has taken the absolute mickey out of me! I am making no effort to return the keys to the banks until wages have been paid, is that illegal?                       I spoke with ACAS earlier and although the advice they gave me was helpful, it was not really useful to me right now, if you understand what I am saying. They told me to write to employer asking for wages and wage slip and to give them a deadline. Then the next steps to take if they don't comply. I will follow their advice, but it seems like it is going to take weeks and I don't have enough money to give them that long. My cut off point was Wed but after travelling to citizens advice and job centre today I can no longer afford to fuel my car to go to work. I spoke to payroll earlier and was told I might get something on Fri but it would probably be about 60% of what I am owed! I cannot write what I replied, but needless to say I am now seeking employment again. I will not allow them to treat me so badly. I worked hard getting to work at 5am every morning and did exactly what was asked of me. All for minimum wage and the very least they should do is ensure that I get my wages on time and the correct amount. Thank you for replying
