  • Employee and Doctors note - My rights?

    Hello,

Firstly thank you for taking the time to read my post, I'll try to keep it as short as possible...

My girlfriend suffers from Rheumatoid Arthritis and currently works full time in a school, unfortunately recently she caught an infection in her hip bone (as a result of her condition) and has required time of work, of which work has been fine with when providing a doctors note.

The condition has improved slightly but the specialist has asked that she remain off work for a further 2 weeks, with pressure from work to return she told the specialist that she would prefer it if she just did 4 lessons instead of 5 for a small period (2 weeks), instead of having the full time off. The doctor agreed and provided her with a doctors note stating that her hours should temporarily be reduced.

She has taken it into work today and the headteacher, after looking at the note has said "That's fine, although we'll need to change your contract for the next 2 weeks so that we can reduce your pay".

Am I right in thinking that what they're attempting to do is wrong and unlawful? As far as the law states, if they are unable to accommodate the doctors requirements, she is unfit for work, they don't have a right to cancel or change her contract?

Also, if she was to return to the doctors to get the original 2 week sick note, can they still reduce her pay?

Her contract is for the full 5 lessons a day.

    Kind regards,
    Sean

Hi Sean, apologies this one seems to have been over looked. What exactly does it state in her contract terms?
