  • Odd one!

    Hi Everyone,
    I have a very odd situation here and would love to have some advice from those who know more than me!

    Long story short I have been suspended for whistle blowing.
    I say suspended, I think that's what's happened but I may have been sacked?

    I work for a private company and started over a year ago.
    I had to report a colleague for health and safety breaches and a safeguarding issue (work with vulnerable people).

    I had a video meeting with my manager earlier this week as I live hours away from head office.
    I thought this was to discuss the issues I had reported but it quickly turned into a disciplinary against me as the person I had reported had made allegations about me.

    I was questioned about smoking at work. (I have an electric ciggy and they have no policy about their use)
    And (you will love this) I was questioned about my relationship with a "murderer".
    I am seeing someone in the armed forces and the only reason my colleague knew about this was because he started acting a bit sexual towards me (I am female) and I put him straight that I am not interested as I am seeing someone.
    He did state that all people in the forces are murderers and it's their own fault for joining up if they get killed etc.
    I did not react when he said this to me, I just said "that's your opinion" but I am guessing this is where the allegation that I am seeing a "murderer" has come from?

    My manager never really gave me a chance to explain anything and I was told I was not to return to work at the moment.
    I just questioned when I would be returning as I commute and I said can you let me know so I can change my train tickets.

    I have had no letter saying I have been sacked or suspended and I would have thought a week is enough time to send an e-mail or a letter.

    I am more than tempted to say "stick it where the sun don't shine" and claim for constructive dismissal but I know that cd is hard to prove.
    Can I make the assumption that I have been sacked? I doubt that I have but in the absence of any other information would I be able to assume this?

    Any ideas?

    Hello Boxoffrogs and a warm to LegalBEAGLES!

    You will find a great deal of help and support here.

    I'm not an expert on this (by any means) but in the meantime:

    I believe "whistleblowing" to be a protected characteristic in employment law - also the "murderer" allegations are inappropriate by anyone's standards.

    Sit back, put your feet up and have a cuppa tea. Someone who can help in more practical ways will be along shortly

      The manager who did the meeting is not British and I don't think she has much knowledge of protected disclosures and the like.
      I think I can see what's happened here, she has taken it upon herself to question me on an allegation that was put to her and I have a feeling that she has also decided to take me off the work rota which is why I have not had any letter from HR.

      I have not phoned in to head office as I thought a bit of time to calm down was a good move, It wasn't until the video call ended that I thought eh? what was that all about and then I got a bit annoyed about it!

      As for the whistle blowing I had no choice, It was serious and I reported it to the company as I have to, I am not the sort of person who can sit and watch some defenseless person be abused.
