        Teaboy2: my question perhaps not asked by the OP is Why does he have to do anything since (a) he resigned and due to his notice period expiring then he left the company and (b) he does not work for them and that any such evidence he would need to ask about would only be if there was a criminal case to answer(which so far we have no evidence for)?

        I just think we are over complicating things. He resigned and he has left the company. What other reason does he have for even bothering with this matter?
        His current employer is no longer chasing up a reference with the old company either so am not sure why the original company are continuing with their own procedure unless someone else is involved.

          Is the lady in question prepared to step up and say what happened re phone calls etc,,and that she instigated any liasons between you?
          Is this client the 'only client' you have had dealings with and accessed their files??

            A note about Witness Statements:

            1. Any statement must be made of a witness's own free will;
            2. It must not be obtained by use of coercion or deceit in any way whatsoever;
            3. It cannot be used in any form of proceedings without the express consent of the person who made the Witness Statement.

            Any Witness Statement obtained in an irregular manner or used without the consent of the person who made it is likely to be deemed or, indeed, ruled inadmissible in evidence. In an employment scenario, the matter could come back and smack the employer in the face. This is particularly relevant if a matter goes before an ET or a court.
