  • Backdating Agreed Wage Increases

    Greeting everyone. I have a query.....

    When I started work at my current employers I was given a verbal agreement that I would have a fixed amount pay increase each year for the first four years.

    In my first year of employment this was done without a hitch, but this year it was 'forgotten'.
    I have contacted my line manager who has confirmed through HR etc that I am entitled to it, but the main gripe is that they are saying that they cannot back date it 2 months to when it should have been implemented, even though they have admitted it was their error that it was not put it in place when they should have.
    Question is, is there any legal right for me to have my rise backdated to the date that it should have contractually paid it from? (I also have an email from one of the directors confirming that it should have been put in place 2 months ago).

    Why can't they back-date it?
    Have they given you a reason?

        I suspect the T & C's of your contract of employment (if you've been given one) will need close scrutiny.

          Well therein is the problem as the wage increase was agreed verbally. Although they ackowledge that the increase should be in place, it is their error that it has not been implemented. There are no T&C's to speak of for the rise.

            Although the wage increase was a verbal agreement, it would appear that you have documented evidence of same.

            In the absence of any good reason why it can't be back-dated, you appear to have a reasonable claim.

            If it were me, I would ring ACAS & have a chat,
            They also have a mediation service.
