  • Holiday Embargo

    Question for a freind.. My freind works for a large legal firm, who are in the process of making redundancies and restructuring. Anyway he is a Facilities assistant and the firm are about to do a large move in London, (he is based in the north). He will be involved in the move and delapidation, as will all the Facilities staff in the north and in London. Due to the lack of staff and the company move, all the Faciltities staff in the North have been told by the Operations Manager that they are not any holidays in July whether they are part of the move or not, (to hold the fort up north). Fair enough he thought, hoever he has since found out that his team leader who is a major part of the move has been allowed to take time off in July. This seems really unfair as my freind has not had any time off this year, due to short staffing, plus everyone will then be clammering for holidays in August/September - making his department short again. Any thoughts on this?

    I must add that my freind and his collegues are scared to speak up due to the redundancy issues.

      Hi Qpips,

      AFAIK the employer is quite entitled to stipulate when holidays can be taken, according to the needs of the business.

      'Fairness' is not really the issue - the question should be, is it legally permissible?

      Also, we don't know the 'back-story' on why the team leader is having time off (not that it matters very much, I'm afraid)

        I agree. The employers duty is to ensure that you can take, as a minimum, the statutory leave due in a leave year. Beyond that they can dictate how and when it is taken - some people get no choice at all and are told when they take all their holiday.
