  • Suspended, Disaplinary Meeting.

    Hello to you all, Firstly could I give my thanks in advance to anyone who is willing to give me advice on my problem here.

    Last week I had a confrontation with my site boss, which at the time I thought that it was nothing major, we had a few words as I had made a ''bad decision'' on the site which was nothing major. The site boss came down and started to rip into my work saying this and that about ''other problems of communication '', I confronted him and asked him which ''other problems'' specifically as I know I do my job very well. Cut a long story short he stated one situation and I proved myself right immediately (a report he said I didn't write out) Which was on another site boss's desk. Anyways I could see he was getting really ****ed off and I said to him ''if you don't want me around just say and I will go but there's no need to belittle my work when there's nothing wrong with it''. So he walked off. I was on site for a further 3 night shifts with no problem, then on the 9th I got a call from my main boss saying I'm suspended until further notice. Today I got a full statement from my boss and they want a reply by tomorrow. the report is a complete joke and fabricated to the high heavens and the reason for suspension is aggressive behavior . Which I can send in pm if you want to have a look.

    The weeks running up to this my site boss hasn't been the most pleasant of boss's and on a few occasions I have personally asked him is he trying to catch me out with things. Also during the confrontation we had been working in minus 4 freezing conditions in the office with no electric, lights or means of warming or storing food as the site had a power cut for over a week. I have not been in the union for 13 weeks yet so they can not help me unfortunately. I have been in this employment for 10 months.

    I would like to know how to respond to this and at the meeting, if anyone could guide me I would be very grateful

    I am afraid that it is entirely likely that it does not matter what you think, what you do or how you respond. You have ten months employment and you require a further 14 months employment to have any protection against unfair dismissal. They employer does not, therefore, need to consdier any niceties about whether they have any evidence or and reasonable belief that you have done anything - to be perfectly honest they can tell you to get the hell out and not even bother with a disciplinary! So the fact that evidence is allegedly fabricated isn't at all important in the long run - that would be the least of your problems.

    I am afraid that unless you think that your employer is actually a pretty fair and decent sort overall, I wouldn't hold out any hope at all of your not being dismissed. By your own admission, and regardless of whether there are problems or not (because again, it doesn't matter because it isn't relevant) it seems that there is strained relationship between you and the site boss, and asking him "more than once" if he has been trying to catch you out may have been too confrontational a style given that you have almost no employment protection.

    All you can do is put your side of the story and hope for the best. Or find another job immediately and before any disciplinary, although if a reference is taken up there is now nothing to stop the employer saying that you are facing a disciplinary.
