  • no pay

    I work for a home care company and get paid monthly. Since starting my employment (october 2012) i have never been paid on time last month was 3 weeks late! My contract states pay day will be on the last working day of the month however this has not happened . My last pay day was due on the 29.03.2013 and i have stil not recieved a penny. I am in debt and about to loose my house what can i do????

    I am afraid that on an immediate basis - very little. Anyone can claim unpaid wages through a tribunal, and this is free for now. But to do so you must lodge a grievance with your employer. And the upshot of doing anything, with six months employment, is that you will be dismissed. You may be able to claim unfair dismissal for exercising a statutory right - but it's slightly complicated and a risk. So I have to ask you, given I can't guarantee that it will get you your money any faster (and the best advice is to get another job) = what are you prepared to do?

    It would help also if you could explain the debt and housing issue - there are others here who may be able to advise on those seperately.

      A grievence letter would make no difference to my emplyer. Ive told him about my personal problems to which his reply was i havnt got any money i cant pay you. Im contemplating handing my notice in tomorow, this is putting me under an extreme amount of stress.

        If this is the truth (and it probably isn't) then there is no way to get your money in the short term. If you are going to quit and need benefits, you must evidence all this or you may get sanctioned. I know this isn't an adequate answer, but it's the best I can do - there is no quick method of getting your money if he won't pay it. And no way of guaranteeing you won't be doing it all again next month. Sorry. I wish there was a better answer, but there isn't.

            is it possible for you to start a separate thread in regards to the issues of hardship because Eloise can help on the employment front but others like my good self can help on the hardship stuff especially on negotiating with those that you owe money to.

              If that is true, then the company seems to be trading whilst insolvent.
