going to extremes tgere but even walking along the street you can inhale tobbaco smoke and all the other fumes in the atmosphere cant see youd win that one ?

I agree it may be going to extremes, but I genuinely had a food intolerance test done and genuinely got the results back on Saturday, here's what came back, I won't give you the full list but one of them was indeed TOBACCO and tobacco smoke in the atmosphere.

Wales,,I totally agree (cos I can't stand ketchup lol)but.........I've insider information on Sapphys tests and I'm already stunned at the hidden stuff in the foods she eats....

As regards smoking....it reeks on clothes,hair,skin...and I can tell if someone has recently had a fag.....(and I smoke lol) My new rule is...outside for a fag (new furniture just been fitted) and cos I can't easily get outside it will help me cut down/stop (I stopped for weeks recently but succumbed to the evils)

I have very bad insides and i well know what foods make it worse but like Inca with the fags i succumb too many times

But wouldn't you still expect to have to say something to the employer? That is the point. It doesn't matter whether you have extreme intolerances or not - you cannot just refuse to do something. If you had a problem you would have to tell them. So it doesn't matter what the reason is, the issue still has to be addressed.

Oh yes, I agree, in my case I would take a copy of the letter with the results in and give it to the employer and ask that they work round it, and as an employer myself I would make sure that none of my staff were put into that situation anyway, but then again we are all non smokers here.

So..........OP and /or colleagues need to approach management with their concerns because just refusing to drive that car constitutes a refusal to work.? Makes sense to me.

One thing i always say is people must TALK to each other ,no one can guess your problems or gripes they have to be told.Ive read so many threads and posts on here where it seems someone has failed to communicate its not that hard really>

That is usually the case yes. Either people don't say anything or they leave saying things until such a late stage that it is hard to do anything about it. People often seem quite shocked when I suggest things like asking the employer the question instead of asking me, because I don't have the answer and the employer does! Often I get asked whether something is "fair" because an OP doesn't think it is, but they have utterly no explanation for why something happened, or why a decision was taken, because they never asked.

One of my other abiding favourites is the "nothing has happened, but it might happen, would I be able to claim unfair dismissal" question. I have actually had people get abusive at me for being unable to tell them what will happen when nothing has happened!

It happens. People get the idea that free to them means they are entitled to it. They would never pay for the advice and act like that (and some of them would never pay for the advice, full stop). I recall one poster (not here) who fell into the "It hasn't happened but I want the answer" category got really nasty about me being unable to answer her query until it did happen, and launched into "you wouldn't treat me like this if I was in your office and paying you". I calmly informed her that she was quite correct. If she was in the office and paying me she would have got the same answer, but had she responded in the same fashion she did on the site, she would have been escorted from the premises, banned from returning and sent a bill anyway!

I agree - that is why I emphasised that the person has not been seen (or reported as being seen) smoking in the vehicle. Smelling of smoke does not, as you and Sapphy observe, mean that someone has been smoking in the vehicle.

Quite. They might only smoke after sex.

If the OP or their colleagues know, as in witnessed, this person smoking in the vehicle then their option to is to report this misconduct - and it is misconduct. This does not give them a right to refuse to drive the vehicle, which is also misconduct - refusing to do their job/ refusing a management instruction.

How about spraying the inside of the vehicle with some sort of scent to mask the stink of stale smoke?
