  • claimant- what do i reply as a remedy?

    I am taking my previous employer to tribunal after making me redundant due to cost cutting, then re advertising my job, changing the name and having potentially a higher salary.

    I have received my case management through and it is asking
    " Set out in writing what remedy the tribunal is being asked to award. The claimant shall also include information about what steps the claimant has taken to reduce any loss"

    I have no idea what to write, or how this should look. I have been unemployed since my redundancy which has now been a couple of months.

    Can anyone help please???

    You can either ask for 'reinstatement' ie getting your old job back or 'damages for wrongful and/or unfair dismissal' ie compensation

    if asking for compensation, you should show you have tried to get other work.

      Thanks, do i need to give a figure for compensation or just say loss of earnings?

            Identify how much wages / salary and other renumeration you have lost from the date of dismissal to the date of the hearing, give this as a figure and then state that that loss continues at a monthly / weekly rate of £x.

            Remember to include pension as well as wages / salary and any other benefits of your job eg health insurance, car etc

            The tribunal will then decide how long it thinks it should take you to find another job and award wages / salary to date + for that time, minus anything you do actually earn. If you take a lower paid job in the meantme, you can claim for the differrence in wages between your old and new jobs for the time the tribunal things it would take you to get back to the previous earnings.
