  • help, crb check after offense

    Hi, please help , i have committed an offence-theft, the most stupid thing i've ever doen, the police were called, they took my details, i didnt have to sign anything, they say we let you go if we can trust you wont do it again
    will that appear on my enhanced crb check, i work in education, if i'd lost my job i'll lose house, husband, everything,
    i dont reallyw ant to disclose it to work if i coudl get away with it, they're funny about me after mat leave anyway (woudl just have a reason to make e redundant or something)
    please help. i'm desperate (and I knwo how stupid that was, im so ashamed, i've never done anything like this)

    Honestly, very difficult to say either way.
    An enhanced check should cover warnings and cautions, which this would fall under, but some slip through.
    How long ago did this happen and where you ever charged with a crime ?

      Have to say this might upset some but its true as i see it,if its on the CRB check it is if its not on the CRB check it isnt nothing the OP can do but hope its not there.
      A lesson for us all here if you break the law the punishment may be more than you think

        Last month,never done anything wrong before,I had terrible

          Were you given a formal warning, if so you will have been handed on a piece of paper at the police station. To mean it sounds like they merely gave you an informal slap on the wrist - So i doubt it will appear on your record.

            Just on a spot,no police station.I feel do bad about it,can not sleep,feel do depressed,I had really bad thoughts,if I loose job I loose everything,I so regret it

                Do you mean on the spot fine or on the spot verbal telling off, if the latter then i can not see it as being formal warning, as a formal needs to be given in writing.

                  Unless this was a formal caution it is unlikely that it would appear on an enhanced CRB, but the problem is that nobody could tell you that for a fact. Enhanced CRB's also contain what is described as "police intelligence" - things that the police may know or suspect about someone and which they deem to be relevant to disclose. But there is no way of telling whether this incident would even get registered as "intelligence" (I very much doubt it but cannot guarantee that), and if it is, whether they would consdier it relevant to a request for information.

                        I have to agree, Eloise. A formal caution is in writing and is administered under the provisions of PACE. This sounds more like what is colloquially-known as a Street Caution. You are correct that an Enhanced Disclosure CRB check will contain information drawn from local force indices (Police Intelligence). However, I would voice a note of caution about such "intelligence" as it can be inaccurate or totally wrong. Anyone can use an SAR under the provisions of Section 7, Data Protection Act 1998 to find out what information the police hold on them. The only information the police are likely to withhold is that which is relevant to active enquiries. There is no harm in anyone SARing the police, from time to time, to ensure they do not hold information that is inaccurate or completely wrong. It is particularly relevant when applying for employment requiring CRB disclosure.

                            on the spot verbal telling off,
                            first they did check my name and address and that i've never been in trouble before
                            the police officer said that he coudl arrest me or i need to convince him i will never do it again and i apologized i said how sorry i am, ive been so scared, i was shaking. he then told me to go home and i went. but i'm so so scared it would come on crb, that they recoord it somewhere, even a note on their system if this was sent to crb, i've got my whole life to lose, i know how terrible person i am for doing what i've done and now trying to get away with it by just wanting it to disappear, i honestly dont know why i've done it, i'm so scared, i can not see the way out if anyone found out, crb or my hubby.

                              I honestly don't think anyone can tell you anything more than we have. It is unlikely this is going to appear on your CRB or come to light - but nobody can promise you that.
