    You are, dear Inca, hugely influentual (probably the most influentual person) on LB 's. I know you are also very protective of your friends. Please do use this influence to make peace now, as you can. The OP is the one who has come here with everything to lose, and Eloise is big enough to absorb a little flack, as she has shown before. When people are in extreme situations they are inclined to lash out at those trying to help them. Doesn't mean they don't appreciate the help, just that they are in extremis.

      I was not going to post again on this thread, but I am prompted to one final time.

      MissFM - I did not ask or invite you to decide whether offense was offered or taken, or to express any view on that matter on my behalf. However, I do not accept "unreserved apologies" to include continued "sideswipes" such as "Militant, Bluebottle, ... and anyone else who can help me" - listing everyone but me. That was not "unreserved" - that is a very definite reservation!



      For the benefit of everyone: There are many (most) areas of this site that I cannot help with or offer any meaningful advice on. However, on employment issues I can. I do not expect thanks, but I do expect manners and not abuse. You can take or leave my advice, but insulting it and me, and continuing to do so will get you no further advice, whoever you are.

      Contrary to what seems to be a perceived opinion amongst a very few here, on this board my answers are generally very time consuming. I am sure that others with experience of advice on boards will appreciate my point. I read a post several times and pull out of it every salient fact and piece of information, filtered through more than 30 years of experience of employment law and many thousands of cases. And believe me, after that many years I can read an awful lot of things that others do not see. My responses are then carefully constructed both to be as comprehensive as possible and as accessible as possible. Each part of a reply is tested back against what the OP has said previously, whether over one post or several; and then the whole reply is retested back to ensure that as far as possible I have picked up every salient point. It is not a legal opinion because the limitations of a website make that impossible, but it is as close as possible to one that I can get. As a result, even a response just four or five paragraphs long can, and often does, take me well over an hour to construct. I do not invest that kind of time to have the OP decide that character assasination is the most appropriate response, or to continue to "jibe" because they think it is fun. The fact that the OP now has no choice but to turn back and re-examine my post is because I outlined very carefully the fact that they could offer no connecting evidence for what they very openly stated from the first post was nothing more than a belief. I explained very clearly what the best legal approach to this situation was to maximise their chances of winning their argument and saving their employment, or if they could not, winning a tribunal. The response I got and continued to get is such that I am not inclined to spend hours of my time advising someone who has yet to even thank me or acknowledge that original advice.

      There are people on this board who have had many hours of my time. Some of them have certainly not liked or been happy with what I have told them. But none of them has suggested that I should have no right to post here, or gone out of their way to insult me personally because of that fact.

      Like everyone else here, I give hours of my time voluntarily and freely - I can withdraw that from anyone I choose. It is actually exceptional and very rare that I do so choose, but on this occasion I have. It is not the first time that people with substantial skills and experience to offer have withdrawn from particular threads, and it will no doubt not be the last time. That is a choice each of us can make as we wish - LB is not a jo for us, but something we care about and believe in. That altruism should not be abused, and when it is there may be consequences. In this case, as in others, there are consequences.

          It will be a bad day for many now and in the future who come onto thiis site for help and adviceif you withdraw your advice,i always say thet people who are not haappy with the advice that you and others give should seek further help and in some cases pay for itthere is no need for anyone should be rude and insulting to you and others i wish it would stop .

                I have to say I am immensely relieved to hear that Eloise.

                I find your posts most informative and more to the point than most. It is refreshing and a good reminder to everyone that the law deals in cold hard facts, not hopes and wishes. People so often spend vast amounts of time and internet bandwidth arguing what they hope the law means, not what it does mean.

                It applies to ALL statute, not just employment law.
                They were out to get me!! But now it's too late!!

                    I have read the responses in this entire thread following my post to Eloise01.

                    Admittedly, I am a novice at this mode of communication and I would like to apologise profusely and unreservedly for the offence I have caused as a result of my badly worded comments. I have realised that some of the phrases I used in response to Eloise01’s contribution left much room for improvement and I was wrong. I had no right to even insinuate that Eloise01, who is a senior forum member, should not be a contributor to this site. I also apologise to all fellow contributors who have had something to say about the issues triggered by my earlier comments. Whilst bullying is an emotive topic for me personally, I will not even venture to use that as an excuse in this instant. I hope my apology will be acceptable, and that contributors such as Eloise01, MissFM, Bluebottle, CleverClogs, Inca and others who have contributed on this thread, can forgive me for this distraction which was caused by a genuine ‘school boy error’ on my part. Thank you all for your selfless and charitable work in helping others.
