My employer has asked its employees (approx 40) to sign a new contract of employment in which the 2 major differences are
1) the commencement of employment with the company
2) the date of commencement of continuous employment for the purpose of the Employment Rights Act 1996
My Background information:
My employment actually began in 1999 and the company changed name and ownership in 2004 (over a weekend) and the same employment was continued
Previous contracts agreed since the changes in 2004 explicitly specified BOTH:
1) the date of commencement of employment with 'the company' as 1999
2) "the date of commencement of continuous employment for the purpose of the Employment Rights Act 1996" also began in 1999
However, the new contract we've been asked to sign now explicitly specifies BOTH:
1) the date of commencement of employment with 'the company' as 2004
2) "the date of commencement of continuous employment for the purpose of the Employment Rights Act 1996" also began in 2004
I can accept the date of commencement of employment with the current company being 2004..
.. but am I right to think that the continuous employment for the purpose of the Employment Rights Act 1996 should begin in 1999? (i.e. the beginning of my employment with the original company)
Any advice will be appreciated.
