Re: Age Discrimination - Employers view

From what you say, it sounds like your company operates passenger vehicles as opposed to goods vehicles. If this is the case, I am sure your company is aware of their obligations under Regulation 3, Management of Health & Safety at Work Regulations 1999 (Requirement to Conduct Risk Assessment) and Section 3, Health & Safety at Work Act 1974 (Ensuring Safety of Persons Other Than Employees), as well as Driver's Hours Regulations. Does your company carry out regular occupational health assessments on its drivers? As a retired policeman, I do know that some drivers are required to pass a periodic medical examination in connection with their LGV or PCV licence.

I think it is more likely that using financial considerations, rather than medical and safety considerations, that your company will fall foul of an Employment Tribunal. Having said that, however, I am going to bump this thread for one of our Employment Law experts to look in on this thread.

    :bump:

Re: Age Discrimination - Employers view

may i ask where you are getting your statistics from

part of my role was an area health and safety rep for a national trade union and what you have stated in my opinion is pure garbage, i am sorry to say

for your information as well. their is no default retirement age anymore and by what authority have you taken it upon yourself to request more testing and monitoring of employees

for your information, it is the 17 to 25 year age group that have the highest accident statistic, thats why insurance premiums are so high for that age group

who are you to state they are not reaching a required level and need improving

        as bluebottle has stated

the management of health and safety at work regulations allready cover this and i find your post offensive and ill advised, and shows a distinct lack of maturity

Nothing wrong with a discussion or a debate just be careful it doesn't overspill and get heated.

I just hope that none of your older co-workers get to see this and realise its you though because I can see you swinging by your feet outside the main gates lol.

              i will tell you now

if you bring this to the attention of your employer or workers you will be labled as a brown noser and sent to coventry

you can then kiss any prospects you had within that company as non existant, and rightly so

              leave this well alone

if it was such a problem, dont you think the HSE would have taken this up

the legislation in place at the moment is more than adaquate
