  • Redundancy, Compromise agreements & PILON

    So we have finally been told our jobs are under threat, no really, when our only customer is closing...

    I've volunteered to represent the office staff, all SIX of us that are at risk at any rate.
    We KNOW the company are a bunch of tight fisted SOB's and will try and get away with the absolute minimum of statutory payments, but we want more, now there's a surprise.

    There is already a precedent been set with Payment in lieu of notice when we last lost some of our people.
    As a start the office people are looking at stat payments plus PILON, but we are going to be looking at a fight.

    So does anyone have any case law I could use or other officially recognised and followed advice to garner this result..

    what you have to remember is that in general a compromise agreement is their for you to sign away your rights under the Employment Rights Act AND ARE A BAD IDEA.

    if they have allready made staff redundant using pylon then that has set a precedence for all future redundency options

    what needs to be done first is see what they offer on the table first

    do any of you have a contract of employment to see if any redundency options are included which may be above statutory provision

      Cheer Milii, that's all on tomorrow's job list..
      I'm aware of the fact that the payment of PILON on prior redundancies produces and implied contract, I just want to be forarmed as I know they will try to wiggle out of this payment.
      BUT if they want us to work well until the final days then they will have to PAY for that..

        yep

        the pylon will be an implied term in your contract of employment as it has been agreed as an expected practice
