  • Notice period change in employment contract

    I have recently handed in my notice at work and specified that i would like to give 4 weeks notice. The next day my employer called me to say that I have to give 8 weeks notice, I expressed my wish to leave asap and he agreed that they would try and let me go asap.
    4 weeks on they have said they need me for another 4 weeks.
    In my original contract it does say that i am required to give 8 weeks but I have just got a copy of the latest contract on the company intranet which details that I only have to give 4 weeks. Which contract is correct? Any help would be apreciated.

    Did you sign any admendment to your original copy when they brought out the latest contract, stipulating you only had to give 4 weeks notice?

    Also what holiday entitlement do you have left for this year? As you may take some notice period as holiday if you have any holidays left.

      Thanks for the response, I've possibly got 1 day left of holiday entitlement and I havent signed any new contract, although I do remember them asking me to re-sign a few years back but im sure I didnt get around to doing it.

        Than am afraid your contractual obliged to give 8 weeks notice, unless you can get hold of your file and see what the contract in there states. Though as you yourself feel you did not sign the admended contract then its likely your still bound to the original contract that included an 8 week notice period - However you could point out what the company intranet states.

        If you already have another job lined up, then my advice would be to simply leave, otherwise you risk losing not just the job you were going to go to, but also your current job, as your current employer could simply refuse to allow you to rescind your notice. Which would leave you standing outside the job centre.

          Thanks for the advise... went and saw the bossed thisafternoon and showed them the contract, agreed that i have worked my notice and agreed to do a couple of days hand over next week.
