  • Being Punished For Being Ill

    I work part-time at McDonalds whilst I'm studying full-time. I work 4 shifts a week which are really important to me because I also live on my own, so I need the money for bills etc.

    I was ligitimately ill for one day this week, I don't phone in sick a lot this isn't a constant occurrence because like I said I need the money but they have told me not to come in for my other three shifts this week as punishment I guess.

    I'd like to know firstly is this legal? And secondly what are my rights on this issue? Losing that many hours would have an adverse effect on my life.

    lt might be because you were ill and it is a food outlet but they will need to substantiate that

        If the illness involved vomiting or diarrhoea, McDonalds were acting perfectly within the law and, indeed, in compliance with the law in telling you not to go in for shifts for three days.

          considering in most area of employment the employee receives no sick pay for the first three days of illness

            The illness was a simple cold that I had from Mon to Wed (Wed being the shift I phoned in sick for) my next shift is Friday, so this isn't an issue of food safety. They are simply punishing me, I text my store manager to find out what was going on and he said, and I quote "I'm sick of people ****ing me over".

            I really want to know what my options are? Those were my scheduled hours that have been taken away. Losing that money is the difference between paying the rent or being able to eat, are they allowed to treat me this way for being ill?

                  unlawful deduction of wages

                  send to macdonalds head office a letter before action that you want your wages credited without delay, enclose a copy of that text
                  I BELIEVE THEY ARE IN EAST FINCHLEY

                          Does not matter if the company is franchised or not, the parent company holds the franchise licence and it still carries the company brand

                          i would also be putting in a complaint on that text sent from a manager, it is uncalled for and lacks any professionalism expected by a manager
