    Hi im just looking for some advice I run a small nursery from a local village hall,this morning a staff member slipped on ice at the entrance ramp the( village hall is a committee run place we hire a room for our group)
    The staff member has broken her elbow .I informed the committee of the situation and recieved an email saying the caretaker had been putting salt down ,I have numerous people who can prove this to be a lie . I am just trying to find out where the blame will lie should the staff member decide to take this further.

    you do not need to apportion blame to anyone

    if anybody wishes to instigate a claim then the policy holder for the public liability insurance would notify the insurance company.

    they would take over and apportion any blame if required

    you need to log an incident report on the matter though for future reference

    remember also

    if this is a staff member then an accident report needs to be done and recorded, as this is a broken bone a RIDDOR would need to be sent to the HSE

    its a legal requirement

    a route cause analysis of the accident would need to be conducted also
