I am specialised but I have chosen to keep that shtump. I am however trained in al aspects of recruitmant LawWhen we love, we always strive to become better than we are.

Ooooooooooooooooooh Mocha just the lady I need then!!
I had a series of very distressed calls from my sister this week.
She has been with one recruitment agency very happily for a few months doing social care work.
She was registered with another agency who she hadn't received any work through. Suddenly they called her and offered her a 6 month temp contract with a company covering someones sick leave.
The pay was not tempting so she turned it down. They came back to her and said 'We really want you for this job, what do you need to be paid?'
She said £12 p/h. They said we cant manage that PAYE, BUT if you do the work through a Ltd company you will be better off and will get £12 P/H. So she used a local Ltd Co service to handle her contract and took on the job...which she loves.
After her first 4 weeks she got her first pay packet and after all the deductions etc, she is taking home nearer £7 P/H.
Naturally she is furious, rang the agency, who denied 'advising' her to set up her pay in this manner.
She has also found out that the agency did not CRB check her to do the job, they apparently used a photocopy of the one attained by her original agency.
Fortunately, the place she works at love her, so they have offered to put her on PAYE on a temp contract, cutting the agency out all together. But its going to cause her some hassle in the short term and she is very angry.
Is there any action she can take against the agency for their mismanagement of her employment contract??

There are only a couple of agencies that do both PAYE and LTD and to be fair 99% of the time you are better off on LTD.
I've PM'ed you a quick question as the agency she is using will determine th answer (complicated but 1 agency does something no other agency does)

All bar one agency when they pay you will, hourly rate and holiday pay all in one go as your hourly salary.
Your sister wants £12 per hour
all agencies this means salary plus holiday pay = £12per hour
Reed this means £12 per hour you will then accumulate xy as your holiday pay which you can recieve at the end of your booking. or use if you need a day off during your booking.
But when you add PAYE and LTD into the mix this basic rule changes again and depends which agency you are using.
and on anothe noter... the company she is working for need to be careful as all agencies have a clause that if a company employs someone that they have introduced to them within 6 month of the introduction then they are liable to pay the agency one years worth of that individuals salaryWhen we love, we always strive to become better than we are.

Yes, it seems her new employers are aware of that and prepared to work round it somehow.
The Ltd Company were who were dealing with her pay were separate from the agency.
