    Hi, I have a friend who is nearing the end of her 52 weeks leave (26 weeks OML and 26 weeks AML). She has been ill recently, and wishes to take sick pay for a couple of weeks before going back, she will get full pay (SSP and a top up from her employer). Thing is, she was told by a friend that if she doesn't go back to work, her employer has the right not to give her sick pay, but also to try and get some of her maternity off her. Is this correct?

    I think employers are allowed to reclaim any OMP if the person does not intend to return to work (usually there is a minimum time limit you have to go back to work before they will reclaim) however this will only be OMP and not any SMP entitlement.
