  • Redundancy help

    Hi i was made redundant without notice back in August 2025 .. still to this day I haven’t received any correspondence or had any contact from my previous employer about my redundancy 7 months on .. I have contacted them on several occasions to see what’s happening with my redundancy only to keep getting excuses … I’m just looking for some advice to what to do next as I feel I’m getting nowhere. Thanks

    Some initial questions that I need answers to before I can advise:

    1. How long where you employed at the company?
    2. Did any redundancy consultation took place, it sounds like it did not?
    3. Was anyine elae made redundant at the same time?

      Hi .. started 9th of July 2011 and made redundant on the 9th of August 2025 .. no consultation or received any letters , only contact I’ve had is when I’ve contacted them to see what’s going on then just keep getting excuses. One more person also got made redundant they haven’t heard anything neither . The company is still operating under a different name . Thank you

        So from what you have posted:

        1. You were employed for 14 years and then told that you were being made redundant, no consultation.
        2. A redundancy situation would have entitled you to statutory redundancy pay based on 14 years of service and your age.
        2. You would also have been entitled to the maximum statutory notice of 12 weeks, unless your contract had a greater notice period.
        3. Payment of any accrued but untaken holiday pay at your leaving date.

        Unfortunately you are out of time to start Early Conciliation (EC) via ACAS because the time limit for making a redundancy pay claim would have been 6 months less a day from 9 August 2025. However I would still contact ACAS 03001231100 as soon as possible and see if you can make an out of time claim, on the basis that you were trying to resolve this with the employer, which I hope you have documented either emails or noted dates/times you have called your employer and who you spoke to.

        ACAS may agree to start EC or they may just give you an EC number, so that you can put in an immediate ET claim. It will then be down to a judge to decide whether to allow an out of time claim, however if they did I would strongly suspect your employer will argue this point. You need to be able to prove it was a redundancy dismissal as other dismissal claims are 3 months less a day on the time limit to make a claim.

        The only other route would be civil action and which way to do this would be dependent on the amount you are owed.

          Is the company still in business? The reference to a name change concerns me.

            Hi yes I have record of all communication and will get in contact with ACAS… Yes the company is still trading under a different name .. was flowers by Harris now Harris’s the flower shop .. thanks for you help I appreciate it

              I believe that if the company is still trading, even under a new name they are still responsible for statutory redundancy payments.

              However I may be mistaken so it would be good to get an answer from the OP to your question atticus

                I have just messaged someone that’s still working there and as far as they are aware they are still not in liquidation yet .. don’t know if that helps or what it means

                      There are two companies listed at Companies House which match the names given by OP, both registered at the same address (which appears to be the trading address of the business). Both are described as 'Active' but one was newly incorporated 9 months ago.

                        Sorry for delay - I am presently not in the UK. The information given suggests that the business has been transferred from FBH to HTFS. The redundancy may have been at the time of the business transfer.

                        The accounts of FBH are not encouraging.
