I have recently been discriminated against in my senior role where I have worked for 5.5 years and am 2.5 years into a serious battle with cancer
My boss called me and one of my direct reports to a meeting under the premise is was a meeting about work activity
No occupational health or HR were in the meeting
He opened by asking me what I though about how the company was supporting me through my cancer battle (very strange to do in front of my direct report)
He then stated that with immediate effect, the direct report in the room is now reported to Him.
He then added that all my other direct reports would be reporting to her.
A week later a formal announcement went to the business confirming this, even though i totally disagreed with the plan, it sent shockwaves through the company as I am very senior, no performance issues and have worked through my cancer battle. She is very junior and not capable of doing the role.
This hot me hard and I was signed off for 2 periods of 30 days (which I didn't take but clearly there is a doctor record) and since them I have developed osteoporosis and broke my leg.
The bottom line is I have missed the 3 month deadline to take legal action (this happen at the end of May) but I understand that due to the cancer and the issues I have this may be extended
I have 2 questions
1) what is the chance of this 3 month period being extended and what should I do?
2) If he discriminates again (which he is coming close to on a daily basis ) what should I do ? - Is there a situation where the 30 days will start again, or does it mean it is juts continuing bad behaviour.
I hope you understand why I didn't complain immediately - I am going through a health battle, he has damaged my mental health (now on anti-depresents and Beta blockers thanks to his actions), ive broke my leg, and there is the small matter of me needing the job.
Any advice greatly appreciated
everything is well documented and a solicitor has already told me i have >50% chance of winning
