  • Advise on Dealing with a Dismissal and Settlement Agreement

    Hi all,

    A friend was recently and abruptly dismissed. I have agreed to post here to gather some general advice as this process is new to both of us.

    They were working full-time for a private company in England for nearly 5 years. There were no notable issues that they are aware of with their role or the work they performed. In fact they were assessed positively in their annual reviews and had been promoted along the way. They were called to a meeting recently where they were told they would be dismissed and provided a lot of information verbally, but it was quite hard to follow. The company said they would provide information via email that they could review and they received what we believe is a "Settlement Agreement". The agreement states that they must take on legal advice and provides information on payments that would be made if the agreement is signed.

    Their grounds for the dismissal are unclear to say the least. It mentions restructuring affecting the role, but it does not really ring through.

    Do you have any advice to offer? Steps to take, things to watch out for and how to work through this process in a positive and effective way. There is a lot of jargon to deal with and the overall process is not that clear. The company is pushing for them to sign off the "Settlement Agreement" ASAP. They are talking to lawyers but the first quoted £1,500 to review/work on the case.

    They are pretty relaxed about it not ready to make any impulsive decisions.

    Your friend should consult a solicitor to advise on the Settlement Agreement. It is usual for the employer to pay an agreed amount of legal fees, so this should be confirmed.
