  • Commission Plan differs from Terms of Employment Contract

    Hi Everyone, First post here and would appreciate some advice on this matter. I hope to be able to stick around and help others throughout the forum with some of the my own personal experiences.


    - I joined a new employer in April 2025
    - The Terms of Employment mentions £63,000OTE in 'Any additional terms and conditions', this is mentioned next to my car allowance
    - This figure was discussed throughout the negotiation of the contract and was agreed to be the yearly amount payable on ensuring I hit my Sales target.

    After a number of months, I was given my target within a Commission letter

    - If I hit my target, I will earn £27,750 this year. £18,750 will be paid when the contract is delivered - which is usually 8-12 Months.

    I understand that this is not unusual - however my understanding in taking this role was that if I achieve my target, I would earn £63,000.

    - The contract, as expected - does include the usual caveat that bonuses are discretionary etc. (Cannot add attachment)

    Is this worth getting further advice on, or is it just a case of sucking it up and earning what I can before thinking about what I want to do next?

    If the terms of employment, as you have set out in your post, states £63k OTE (on target earnings). What is the salary element and what is the commission element?

      Thank you for the welcome. The Base Salary is £75,000 and then £63,000OTE
