Aqua instructor question.

  • Aqua instructor question.

    I have membership to a leisure centre to do gym classes and aqua classes. I do about 3 aqua a week all with the same instructor. She has got in the pool on rare occasions which everyone in the class loved. Only for the last 10 mins but still it’s nice for a change. The first time was Christmas 2023 then July and Christmas last year. She was going to get in this July but her boss has now told her she isn’t allowed to. So I’m wondering if she has any legal protection against being sacked if she was to get in the pool now considering she has done before and nothing went wrong everyone complimented her for it also another instructor has also got in the pool a few times I have no idea if this other instructor has been told the same or not. Also her boss was aware that she had got in the pool last July but never did or said anything. Reason I’m asking is cos the instructor I do aqua with was due to get in again in July but now she is worried she could be sacked if she does.

    A few thoughts.

    1. This instructor knows what to do to avoid the risk of being dismissed.

    2. Is she an employee or a contractor?

    3. If employed, when did her employment commence?

    4. Is there a disciplinary procedure/policy?

      She is contracted to certain classes/hours each week. Im not sure how long she has been there but I would say at least 5 years. I’m not sure about the disciplinary procedure/policy. Her boss told me she’d has been told off and she told me that she has pointed out to him another Aqua instructor has also got in the pool during classes before. So I’m guessing for her to point that out it must have been more than a simple telling that she shouldn’t get in.

      I have messages on my phone of me and another woman who does aqua classes talking about this instructor and the other who sometimes gets in to prove this has happened a few times and nothing was said til now also last year I told this woman’s boss she had got in the pool the day before and he said he might get in at some point tho he never has (he also does aqua classes).
