Both parties are expected to make it very clear either the nature of the claims or the defence to these claims. If your employer has only made a blanket denial to your claims, without addressing specifics, did they indicate whether they would be providing a supplementary document known as a Grounds of Resistance?
If not, then you you have a few options:
1. Make an application to the Employment Tribunal (ET) asking them to order your employer to clarify their position on the specific allegation.
2. Using Case Management Orders which is where the ET issues orders as part of case management requiring your employer to provide additional information in the defence of your claims.
3. If there is a Preliminary Hearing (PHR) you can bring the issue then.
I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.
I do my best to provide good practical advice, however I do so without liability.
