    Can employers solicitor redact theirs and my documents after disclosure?

    The redactions are names of children. I raised at the preliminary hearing in the agenda that all disclosed document should be unaltered, and there were no objections from respondent. They didnt mention redactions in the agreed list of issues. Now when its time to finalise the bundle, they took it upon themselves to redact names from their own and my documents. because they dont want certain names mentioned in a public hearing. They never asked if they could redact, they simply told me that they are.

    This isnt a hill i want to die on, so if its better to just let them do it then thats what i'll do.

    If there are names in the documents that are not relevant to the hearing, it is quite common for these to be redacted as ET final hearings, unless otherwise ordered are public. If the names are of children who are minors this would be more relevant to redact.

    If you do wish to object then you would need to make an application to the ET.

      I agreed to the redactions and have now been sent the bundle. They've only redacted the names in some documents, not all of them. So what was all fuss about about? It's like the know I'm an LIP and are deliberately doing things to take me away from preparing for the hearing. Ive now had to go through a bundle of over 900 pages twice, which is time consuming.

      Am I supposed to let them know theyve not redacted the names in some documents?

      As it was their decision to redact names, not an order from the court, what happens if i accidently say one of the names at the tribunal?

        The respondent is responsible for the bundle and any required redactions. If you believe there are names in there that should not be then you should let the respondent know.

          The redactions are not a requirement, its something they took upon themselves to do. I don't particularly care either way. It's not a case of that I think the names shouldn't be there, it's a case of they said they were going to redact the names but haven't done a good job of it. They have paid staff to sort these things out. It shouldn't be up to me to sort out the documents to the way they want them. Now if the court had ordered the redactions, that would be a different matter, but they haven't.

          I just did a name search so don't know which documents contain the names. If I tell them they missed some documents, then they'll fix it and send a new bundle of over 900 pages for me to review, which will again take me away from preparing for the tribunal, which is next month.

          I'm just not going to tell them.
