  • Employment Advice Needed - Desperate Situation

    I was employed by a UK based entity from Oct 2006 continuously on a full-time basis, in the year Oct 2022, the company transferred me to another Dubai entity (both UK and UAE company are subsidiaries of a holding company). However, the UK company also retained by services as a consultant and have been paying X amount every month. After my transfer to the Dubai entity, the UK entity issued me P45, but no end of employment or gratuity was paid.

    From Oct 2022 to Oct 2023, I worked in the UAE entity.

    From Nov 2023 – they made me to quit the UAE company (without any compensation) and made me to join another company (in which the holding company is a JV partner). All along I was promised that my employment is continuous (though my contract with this new company says – “No other previous employment will count as part of your period of continuous employment with us”.)

    I have now decided to resign from my employment for various reasons (including the consultancy service I am providing for the UK company), since the atmosphere in the office becomes toxic and I think I am better off returning to UK and find a new job.

    My question to you all is - since I was issued with p45 from UK entity and asked to enter into new agreement with different entity of the same group - Am I eligible for any end of service gratuity? Secondly which entity will be responsible for this payment?

      My queation before providing any further advice is why do you think contractually you are entitled to an end of service gratuity?
