  • Can My Employer Enforce a 3-Month Notice Period for an Admin Role?

    Hi,




    When I accepted my current part-time, remote admin job, I was told there was opportunity for the role to grow. However, after passing my six-month probation, I’ve now been told there are no progression opportunities or salary increases, and it’s unlikely to change.




    My contract states that my notice period was 1 month during probation, increasing to 3 months after passing. When I questioned this before signing, I was reassured that the notice period would be “negotiable.” Now, I’m worried that I’m effectively stuck, as most employers wouldn’t wait three months for an admin assistant.




    There’s no mention in my contract of financial penalties for leaving early, but I’m concerned about potential consequences if I find another job and want to leave sooner. Can my employer legally enforce the full 3-month notice period, or could I argue it’s unreasonable given the level of the role?




    Any advice would be greatly appreciated.

    In theory an employer could sue you for damages for breach of contract for leaving without giving contractual notice but it's very unusual for an employer to do that, especially in an admin job like yours. You can pretty much assume that won't happen.

    The more practical consequence might be that they mention it in any references they give, or refuse to give a reference at all.

    Is it possible for you to negotiate a reduction to one month now, before you start job hunting, in view what they have now told you about future prospects and salary?
