  • Mobile worker travel time

    Hi
    I work for a large company installing heating systems. I am based from home and my contract describes me as a remote worker. I have opted out of the 48hr working time regs.
    I start work every week day from home with a company van and travel to customers homes (different addresses every week sometimes every day) I then travel home.
    My contract is for 41.5 hours per week 1/2hr unpaid lunch and 2 x paid 15mins breaks per day.
    My manager is requesting I travel to and from work address's unpaid for 1/2 hr each way.
    I thought I would qualify as a Peripadetic employee (ACAS) and as such I should be paid for all travel?

    I have read the acas and gov info but I’m left a bit confused.

    Any help or guidance would be greatly appreciated.

    To clarify is your manager now asking you to attend a company place of work and from there each day go to the first customer's home?

    What will now happen at the end of the day?

      No, i will continue attending customers homes first and last job and start and end my day at home.

        Basically I am told i wont be paid for the 1st half hr of travel both from home and to home.

          In my view based only on what you have posted you appear to be a mobile (peripatetic) worker who works at different locations away from your normal workplace.

          Travel time for peripatetic workers to and from home to the first and last job of the day is generally considered working time. This is because during this time, the worker is performing duties for their employer, such as traveling to different client locations

          However, whether this travel time must be paid depends on the terms of your employment contract. Potentially if the contract states that you are paid for the hours you work or if there is a general understanding that workers are paid for hours that they work, it is arguable that travel to and from first and last customers should be paid.

          If your contract states that there is no entitlement to be paid whilst travelling to and from home, then such working time will not require additional payment. This is also likely to be the case if an individual receives a salary for their set hours of work (which does not including travelling to and from home), but do have an obligation to work ‘such additional hours as are reasonably necessary’ then there is an argument the employer can put forward that they do not have to pay for the travel time that is now regarded to be working time
