  • Sick Pay After Long Term Sick Leave

    HI.

    I have off been for nearly all of 2024 with Prostate Cancer and related treatment.

    My employer has been brilliant and I have used of all of my contracted sick pay entitlement through my employer in December.

    Currently I am on a phased return to work, working three days per week, only getting paid for those three days.

    Because of my ongoing treatment which continues until December 2025, I want to permanently reduce my hours to three days per week I would like to know if the employer can claw back some of the paid sick leave I have received, given that our financial year ends on March 31st and our sick pay is calculated December to December.

    Can someone please shed some light on this?

    I am not sure why you are asking this question unless there is some wording in the company's sickness absence policy or something that they have said to you which makes you think this may happen?

    If you have been paid sickness pay in accordance with the company sick pay policy, any new working arrangement for returning to work should not affect this.

    Can I suggest that you ask the company to consider continuing with a 3 day week until Dec 2025 as a reasonable adjustment due to your ongoing treatment.

      Thanks for that. I never thought about continuing my phased return until December. I have just suggested this to my manager for him to pass on to HR.
