    Hello! Leeds tribunal have confirmed today that they are only just dealing with ET1s submitted in September. This means that by the time they get to processing mine which was submitted in December, the respondent may try to claim it’s out of date. Leeds confirmed they’ve received the ET1. Does anyone know if the notify the respondent straight away or does it have to be physically worked on before they send the ET3 to the respondent? Even the person at Leeds I spoke to didn’t know the answer! Many thanks

    On the ET1 form, top right hand corner are a couple of boxes to be completed by the Tribunal one of which is the date they received your ET1. This will be the date that determines whether your claim is in time.

    Your claim form will go through an initial review with the tribunal administrative staff. This is to check things such as whether you have used the right form, if it contains the required information and if it can be sensibly responded to by the other side.

    If your claim is accepted a copy of your completed ET1 form will be sent to your employer who will have 28 days from the date of receipt to respond to the claim if they intend to defend it.
