  • Monaco Solicitors - has anyone used

    Hi

    Has anyone used Monaco solicitors for advice?

    They offer two packages 660 for 2 hours with a senior solicitor and 330 for two hours with a junior solicitor.

    I have a preliminary hearing coming up on the 25th November 2024.

      I need some advice on the following:
      - How to complete a list of issues properly.
      - Prior to the preliminary hearing if you cant agree a list of issues with respondent solicitor what to do
      - When evidencing a disability can I solely rely on medical notes or do i need a GP report, consultant report or expert evidence.
      - advice around a completing a schedule of loss.
      - how preparation time orders work.

        In answer to your 5 points:

        1. In your ET1 form, you will have set out your version of what you consider to be main relevant facts. In the response, the respondent will have set out their version of what they consider to be the relevant facts.

        Identifying the factual issues in the case will involve defining and summarising the main relevant factual matters about which you and the respondent disagree. Each area of disagreement is a factual issue which needs to be included on the list.

        Typically if the respondent is represented, they will provide an initial draft list of issues which the claimant can review and either agree, disagree or partially agree and may have further issues to include if any have been missed off from the ET1

        2. You can go to a preliminary hearing without the list of issue being agreed between both parties. During the hearing the list issues will be considered and if at the end of that discussion, there is any disagreement between the parties in relation to that list, it is likely that the judge will make relevant changes to the list.

        3. If you are claiming disability then you have a better chance of proving this with a GP report, consultant report, expert evidence or combination thereof.

        4. Do you have a Schedule of Loss (SoL) template? This will help provide a framework to guide you through your calculations.

        5. If you are a litigant in person (LiP) the tribunal can order the respondent to pay an amount to cover the time you or an unpaid adviser spent preparing a case. This is called a preparation time order.

        There is a set amount you can claim for preparation time. The current rate ,I believe is £41 an hour, so if you spent 10 hours preparing your case, you could ask for a preparation time order for 10 x £41, which is £410.

        You should make this figure part of the claim you present to the respondent and this may be useful if you enter settlement discussions.

        You can ask for a preparation time order if you think the respondent:

        1. Has a no defence

        2. Is behaving unreasonably - for example by not disclosing documents

        3. Is not complying with other directions from the tribunal

        However please be aware that the general principal of a tribunal is that each side pays its own costs and it rare for a party to be awarded costs.

          I did pay £660 for one hour to have my papers read and one hour for questions and I was very disappointed.

              I'm coming up to my first preliminary hearing and the respondent is preparing a PH Bundle. The Bundle has my list of issues but the respondent has chosen not to submit one and instead rely on mine as a legal basis with the caveat that they don't commit to agreeing with my list of issues.

              Initially they did submit one but I made an application to amend by adding further counts "relabelling". Now they have chosen to go with my List of issues.

              If they don't submit a list of issues can they submit one later on? why would they do this? seems like strange behaviour.

                There is only one List of Issues document. So if they have "issues" then these will be added to the one document.

                One of the things that will get discussed at the PH will be the List of Issues with the Judge trying to get agreement between both parties as to the List.
