ET3 two weeks overdue

Employment tribunal advice please.
The deadline for my ex employer to provide the ET3 was two weeks ago. It was recieved yesterday by the court. Am I too late to request a default judgement?

What reason, if any, has the respondent has given for the delay in submitting their response?

As far as I am aware none. I haven’t seen a copy yet as the admin office said it needed to go before a judge but other than the fact is was only received yesterday he couldn’t say.

Given that a submission has been made, albeit late, then in the interests of justice the judge may well allow the ET3 to be submitted. You will notified onece he judge has made a decision.

So a individual would just be struck out as out of time but the respondent could be okay “in the interest of justice”
Seems fair. *♂️

An individual with no reasonable reason for not submitting their claim in time would potentially be struck out but this also have to be considered by a Judge.
