  • Going to Industrial Tribunal

    Hi
Would like to get some advice to go to the Tribunal
    1. ACAS provided a certificate
    2. What are the next things to be considered? What are the consequences?
    3. After applying - the procedures to withdraw and what are the consequences?
    Thank you.

Tagging ULA for you who I am sure will be able to help.

Could you give us some idea what's happened at work and what sort of claim you are considering.

What stage have you got to? Have you actually notified ACAS and do you now have an Early Conciliation Certificate from them?

Small point but Industrial Tribunal changed its name to Employment Tribunal many years ago.
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.

Your next step is to decide whether or not you want to pursue an employment tribunal (ET) claim by completing and submitting an ET1 form. There are strict time limits on doing so, which for the majority of claims is 3 months less a day from the incident being claimed about.

Typically, each side pays for their own legal costs except in certain circumstances were a judge may award costs against the other party. I would also caution about bringing a claim that has no merit as the ET, like any court, does not like having its time wasted.

Going to an ET is stressful and likely to now take more than a year and even into 2026 for a complex case to reach a final hearing, so I would suggest take this into account. If you can settle the claim, then you may want to give this serious consideration.

There is more information we can provide but on the limited details in your post it is difficult to provide a meaningful response to your specific situation.

If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.
