  • RTW documents and TUPE

    Hi,

    I am a UK passport holder who have been working in my cunrrent role for ten years. Il transferred under TUPE to a new company five years ago.
    My new employer is now requesting I upload my RTW documents to their online portal.

    I assumed RTW was a pre-employment check only and I have no wish to upload my data to a portal of unknown security.

    Any Advice? Thanks

    Have you discussed your concerns with your emploer, and asked what assurances they can provide to allay your concerns?

    Remember that they are under an obligation to keep records of these things.

      The 'new company' has legal obligations to do a fresh RTW check.

      Search Home Office latest June 2024 guidance on...
      "Employers guide to right to work checks" - and qualifying dates. TUPE is explained katee on page 38 of 70

      Employers will do whatever they can to now comply with the law. Failure is likely to mean huge financial penalties levied against the employer.
