  • Final warning and redeployment

    Hi
Apologies in advance for the long post but need some support.
I have been suspended and under investigation for safeguarding misconduct which occured under my supervision. The initial suspension was due to a second issue which the investigation found I was not at fault for but they also investigated a prior issue (which was actioned and dealt with as agreed at the time) and it was found that under their opinion I had put safety at risk through poor management and supervision although I had explained that was not the case in my hearing.
The outcome of the hearing is that I have recieved a final warning (to remain on record for 12 months) and redeployment.
I have checked my disaplinary policy & contract and it doesn't give any specifics on what this is/ could be.
Are there any rules around redeployment?
    Can they change hours/working conditions/holiday allowance/wage etc?
If the proposed redeployment isnt suitable can I refuse? What would happen then?
    Would/could I then be dismissed?
I am looking into appealing this as I believe that the whole process has been poorly handled and I believe I could not have done anything different to prevent the issue occurring.
    Very stressed by all this
    Thanks for any guidance available

Not only do you need to refer to the organisation's disciplinary policy but also your contract of employment in respect of how they deal with the redeployment and the terms under which this would be offered. They would need to avoid any potential breach of contract.

Redeployment, demotion or loss of seniority are often considered as alternatives to dismissal. Until you know what they are offering under redeployment and what, if any, affect this has on current contractual terms, it is difficult to advise what your options are.

If you have questions either on my response or as this process progresses then please just come back to this thread.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.
