  • Gross misconduct charge after I resigned

    I’ve had an increasingly difficult relationship with my employer over the last couple of months. I passed my probation in March but I’m struggling to progress my project due to either poor, changing or no decisions by my management. I work for a small family firm who dont understand what a project manager does and they expect me to do everything related to IT and blame me for not being able to deliver on my own. I’m not progressing here and also recently was diagnosed with a heart condition that my employers are aware of. Two weeks ago I decided I wasn’t going anywhere with them and resigned giving 3 months notice.

    Last week my employers suspended my and accused me of gross misconduct although they’ve not specified the details. The use monitoring software and say I’ve not been working however a) the software doesn’t record things like teams meetings b) my role doesn’t need me to be online all the time as I do offline planning, thinking etc and c) I’m unable to do a lot currently due to blockers that I’ve escalated but are outside my control.

    i would prefer to just work my notice and leave but I suspect they want rid of me. I’ve worked here for 15 months. I don’t have any access to the systems since being suspended and haven’t been provided with any dismissal policies or any thing in writing. I’m convinced I’ve done nothing to justify such a charge but don’t Lomé what they consider gross misconduct.

    can anyone give me advice on what to do next? I’d prefer to just leave at this point with mutual agreement although I don’t have a new job so the notice would have been useful but I sense they want to go after me and not pay any more. I have no way to contact them and no idea when they will contact me.

    Can you just confirm that the notice you gave was what you were contractually required to provide and what notice does your employer have to give you.
