I have a substantive preliminary hearing to decide if my claim is out of time.
Do I have to submit a witness statement ahead of time as I would at the main hearing?

If you want to your case to survive this hearing and get to the main hearing, you need to pull out all the stops in demonstrating why your case was not brought out of time.

I intend to fight my corner vigorously. I just don't know if I have to submit the statement in advance or just make it on the day? I will submit the documents in advance as instructed.

If you intend to submit a statement, do it in advance. Do not try to take the other party completely by surprise, it rarely goes down well.
