    I believe that management are in breach of confidentiality by revealing to my present manager that I had applied for the same post.
    It is their belief that my attitude and reason for raising grievance is a result of sour grapes as I was unsuccessful in my application.

    Firstly this information could only have come from the higher manager who was present at the interview as I did not disclose my application to anyone.
    I asked the manager where they got this information at the grievance mediation, but was not given an answer.

    My question is, because this was disclosed during mediation meeting, does this stop me from taking this to the Gdrp regulator?
    This disclosure has further impacted on my mental illness as I have been diagnosed by the GP.

    Sorry another question at what point do I get any protection if at all under the equality act, my condition started Oct 23. Presently under medication for mantal illness.

    It doesn't sound like a breach of data protection law/GDPR. I expect the company, if challenged in court, would say it had a "legitimate interest" in your current manager being aware of your work history with the company. Does any company policy say that information about you will be kept confidential from your manager?

    Whether your mental health amounts to a Disability under the Equality Act is a question of fact, the affect it has on your life. I would expect your GP to give a professional medical opinion on whether you had a Disability under the Act, which you could show to your employer. It's not obvious how that Disability would be relevant to your GDPR question though.

      Hi,

      My work manager has no access to my personal information due to GDPR. This information should not have been shared.
      The fact that the manager is now using the information as a way of defamation of character against me I find unacceptable now.

        Well if you believe it shouldn't have been shared bring a grievance about it. An additional grievance to the one you are already involved in.

          That's what I'm thinking but not sure I can use the information disclosed in the mediation during the other grievance that's on going?

            Have to agree with PallasAthena line managers, in order to carry out their function of managing staff, will have access to personal information on their reportees.

              My manager is not my line manager their access was taken away from them last year, the manager has no access to personal information.
              To make a comment that my attitude behaviour is a result of me being unsuccessful in applying for the role is not only unacceptable but also breach of confidentiality. That's what I believe.

                Then as you have been advised if you believe there has been a breach of confidentiality then you have the option to raise a grievance.

                  My issue is can I use this information as it was revealed to me during grievance mediation and that is supposed to be in confidence.?

                    Was this held internally?
                    Was it a suggested outcome from your grievance hearing?

                      Hi,
                      Yes held internally, yes suggested outcome of grievance to have mediation though I disagree with appeal also not withheld.. Management having conflicts of interest and still did not address the issue I reported.
