    I am at this hearing.

    I have a question they judge specifically stated "he is not concerned about construtive knowledge" is this wrong? Shouldn't he take that into account when dealing with the question of if "i am disabled"

    Also I sent another question to your inbox, can you answer in private as I would rather not have such sensitive information public?

    • Constructive knowledge is about whether the respondent should have been reasonably aware of your disability.

      My understanding from the PH notes is that this hearing is specifically about your disability status not about whether the employer had knowledge of this.

      Although if you can prove the disability point and this is concede, then the next point would be that the respondent would have had reasonable knowledge of this due to x,y,z reason/s.

      • In response to your PM. If the Judge is registered at the same GP practice they need to declare this interest for openness and transparency to all parties and the Tribunal

          I think I won. The Judge made comments "he accepted my evidence" and "they didn't counter mine" and "he believe the effects of my conditions", he reserved judgement.

          Looks promising. Thank you ULA your guidance might of helped me get some justice during my disability status

              Yeah I will wait. The biggest point at the end which the Judge noted was that everything I said was not contested. The R didn't have an arguement when judge asked them.

                It seems the Scottish Tribunal system is a lot a faster at dealing with claims than in England.
