  • Dismissed due to mental health

    I started with A new employer 01/07/22 as a Grounds Maintenance Team Leader, and dismissed on 31/10/23 due to mental health problems, which I had when I started,it was under control with medication, but made worse by the actions of this employer.

    It started to go wrong in May 2023, I had been given a written warning over an injury that occurred with another employee that I was working with, and had no direct involvement with that injury, that is I never caused it. I appealed against that decision, but it was upheld.

    After that My line manager had been on My back about problems with My work, that did not exist, Saying that I have thrown My toys out of the pram, when I just wanted to sit on My own at the end of the day, waiting to go home. Taking My team mate away from Me and given Him to another team leader, who did not need help, accusing Me of having an attitude and upsetting other team members, which was untrue.

    Due to this I had a mental breakdown on the 26/07/23, during My time off sick, the only support I had received from My employer was 2 OH Psychiatrist visits.

    I had 2 welfare checks that needed to be done face to face, the second one was horrible and I just wanted to get out of the meeting as fast as I could, when I got home I broke down again, and was signed off sick again.

    I had to have a meeting with head of department, but because I was in such a bad place I could not attend. I received an email from HR to say that The decision had been made and that The outcome would have been made at the meeting, as it had already had the outcome sealed, I just told them to get on with it. I was never offered another role in the company.

    I also believe that My employer never read My OH report fully, and I also believe My line manager wanted Me out, as it has happened to a previous employee.

    Sorry my response is going to be a few questions for which I would be grateful for a response.

    1. You do not say whether you appealed your dismissal, which you have the right to do?
    2. You state you have mental health issues, did you have this when you joined the company and if so did you advise them of this?
    3. If you did was there any discussion about the need for any reasonable adjustments?
    4. Were the 2 OH visits to a psychiatrist suggested by the company and did they produce reports? If so was there any reference to reasonable adjustments or anything about returning to work.
    5. Was the meeting you did not attend set out in writing as a disciplinary meeting for which the outcome may be your dismissal due to capability?
