  • Injury unable to do job fully

    I work in a manual job involving a lot of lifting and moving things around outside. 5 months ago I injured my shoulder possibly from work but not sure as I was doing lot out of work too. Had scans and tests and it's looking like nerve damage but haven't had an accurate diagnosis yet as I'm waiting for a result.

    Originally my employer put me on lighter duties which worked out not too bad as through summer there is less lifting involved. I have been frustrated not being able to do my job fully but have done the best I can and had no complaints. Today however I was told that it had been noted that I have had a lot of time off over the last 12 months which the majority is from this injury it was very painful at first and I had just under 3 weeks off. I also got asked if I still enjoy my job. I would say I can probably do my job about 70% to what I would normally do it.

    It took me by surprise and although it wasn't said it felt like they were trying to send a bit of a message. I've seen 3 other people have some health issues that went on light duties and ended up leaving (although to all the staff including me it felt like they were pushed out) so I'm feeling a little uneasy now.

    What I want to know is what rights do I have if any to stand my ground and make sure I don't get pushed into something I don't want to happen?

    How long have you been employed at the company?

    Have you provided any medical information to your company such as a GP/consultant report in regard to your injury?

      I have been there 2 years 8 months now and the only thing I have given to them physically is the sick note I had when it first happened. I have just told them them what was said at each appointment I have had but they have never asked for anything officially it's just been informal.

        You say you are waiting for a accurate diagnosis do you know how long that will be.

        I think you are going to need to engage with your employer about your injury and explain that you are awaiting test results to get an accurate diagnosis. Depending on the outcome, there may be a need for your employer to consider reasonable adjustments to your role having taken account of GP/consultant recommendations or and occupational health assessment.

          Yes I will be getting results this week and they know that as I have kept them informed of every step so far. They seemed to be understanding and have kept me off anything too heavy but it was just the tone of this last conversation that gave me the impression they were getting frustrated and it felt more like they were on the offensive rather than being supportive.

            I think you need to wait until you get your results and what that may mean for your ability to carry out your job longer term before I can advise further. Please post back here once you know.
