  • Redundancy selection pools

    During a collective consultation phase of redundancy (where more than 20 roles being made redundant), can the selection pools initially communicated at the start of the consultation change?

    I assume that if the company wanted to add in any employees that were not initially informed they were at risk and not part of the consultation, they'd need to either start consultation again or start a new redundancy exercise for those employees.

    However if there were employees initially told they were at risk, but when the selection pools were announced they were not in a pool, could they then be added to a pool as the consultation process plays out? If so are there any rules around this? E.g. amount of notice that must be given? Or can selection pools change multiple times during the course of consultation?

    Collective consultation has to happen if 20 or more roles are to be made redundant in a 90 day period. The consultation process must be completed before redundancies can take place.

    Yes the pools can change as a result of this consultation as the process may determine that other roles should come "in scope" of the selection pool.

      Thanks. If the process determines other roles come into scope, are there any rules around that? For example, could the employer on the day before consultation ends update the selection pools with new roles and then finish consultation the next day?

        AS far as I am aware there would need to be 30 days consultation prior to any dismissal.

          Thanks again. So to summarise, am I right in thinking that selection pool members can be changed during the consultation process and someone who is originally informed they are at risk but not in one of the originally identified selection pools, could be added to a pool at any time during the 30 days consultation without notice.

          And if some in a role elsewhere in the company that has not been identified as at risk, for that role to become at risk they would need to do another 30 day consultation for that role?

            If someone has been identified as not being part of the selection pool initially and then for whatever reason i.e. the pool was determined as a result of collective consultation to be too limited in scope and then falls into the selection pool then they will need to be notified of this fact.

            There’s no time limit on how long consultations last, but there is a minimum period before you can dismiss any employees in this case is 30 days.
